A Partner of Integrites Kazakhstan joins the Kazakhstan International Arbitrate

26 September 2011. Kurmangazy Talzhannov, a partner of Kazakh Office of International law firm Integrites, became an arbitrator of the Kazakhstan International Arbitrate – the first arbitration court (third-party tribunal) in the Republic of Kazakhstan.

The Kazakhstan International Arbitrate (KIA) is a permanent arbitration institution (third-party tribunal) which takes into consideration disputes under the legislation of the Republic of Kazakhstan as well as rules of law chosen by the parties.

The KIA may act as third-party tribunal and international commercial arbitrate as far as the procedures of dispute consideration are the same. The distribution of powers between them is carried out on the basis of residence: disputes between residents are considered under the Law on third-party tribunals, disputes between the parties, at least one of which is a non-resident, are considered under the Law on International Commercial Arbitration.

Nowadays arbitration agreements have become standard in foreign economic contracts, and international commercial arbitration is a dominant tool in resolving disputes between companies of different countries (unlike state courts), because almost all around the world it is easier to enforce arbitration awards, not foreign court decisions.
