Yaroslav Abramov, senior associate of International law firm Integrites, moderated and delivered a report on the TaxPro2013 conference on tax planning, corporate and private structuring.
TaxPro 2013, the key event in the sphere of international tax planning, sponsored by Bosco Conference, which took place on February, 12 at Premier Palace Hotel, attracted nearly 200 participants, representing 20 jurisdictions. Yaroslav Abramov moderated the conference and delivered a report, devoted to the problems and prospects of transfer pricing for standard business structures used in Ukraine, during the first session. Mr Abramov analyzed the tax legislation and devoted the biggest part of his report to the legal regulation of transfer pricing as well as analysis of the current situation regarding the use of tax optimization schemes. During the speech he paid special attention to the expected economic effect of the Law of Ukraine "On Amendments to the Tax Code of Ukraine (regarding transfer pricing)" for the state budget and risks for business.
«Despite the vast experience of European countries in the use of transfer pricing tools, to achieve maximum efficiency in Ukraine two issues must be resolved at the legislative level: fiscal authorities’ objectivity in the determination whether operation is market-based or not, including the determination of regular price and its interplay with the specific market conditions and economic substance of the operation; and the effectiveness of cooperation between Ukrainian and foreign tax authorities in terms of defining related persons and controlled operations» - highlighted Yaroslav Abramov.
