On April 9, 2015, at a plenary sitting, the Senate of the Parliament of the Republic of Kazakhstan considered in the second reading the draft law “On Amendments to Several Legislative Acts on Issues Regarding Natural Monopolies and Regulated Markets”.
The above draft law is aimed to minimize the administrative barriers in operation of natural monopoly entities, to increase the transparency of the tariff formation process and the operation of natural monopoly entities, to ensure the performance by natural monopoly entities of their investment obligations, to exclude unreasonable expenses, to optimize the tariff procedures, to protect the customers’ rights, and to simplify the procedures for application consideration and decision making by the competent body.
The draft law is supposed to establish the obligation of natural monopoly entities to perform the investment programs and, on a priority basis, to allocate funds for the reconstruction, modernization, expansion and support of existing assets and the reconstruction and re-equipment of fixed assets.
To improve the quality of services provided, it is stipulated to establish the authority of the competent body to develop the standards for the provision of services by natural monopoly entities to customers and to improve the mechanisms for conducting public hearings for discussing the contemplated tariff (price) for regulated services.
In the course of consideration, the draft law has been amended. The draft law, as amended, was returned to Mazhilis.
