INTEGRITES arbitration team has successfully represented the interests of the Ukrainian respondent in a dispute with a Russian chemical giant  that filed a claim to the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry seeking to invalidate the price clause in the additional agreements to the Contract, and then to approve a new wording of this clause, which contained a price much lower than provided for in the current version of the Contract.

Ukrainian respondent was exposed to  over $16 million, which the Claimant could have further claimed as overpayments under the contract, as well as to  new proceedings with similar claims but for an earlier period.

INTEGRITES team, acting as counsel for the Ukrainian respondent,  managed to prove that all the claims against it were groundless and most of them were not capable of settlement by  arbitration. As a result, the arbitral tribunal terminated the proceedings regarding the latterand dismissed all other claims of the Russian company.

INTEGRITES has successfully represented the interests of the Ukrainian respondent in a dispute with one of the largest Russian companies in the chemical industry for over USD 14,5 million.

The Russian claimant filed multi-component claims to the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry for the recovery of damages, loss of profit, penalties and moral damage from the Ukrainian company for the amount of over USD 14,5 million, and a specific performance  claim for additional delivery of products under the contract. Also, the Russian company sought to invalidate additional agreements to the contract as executed under the influence of difficult circumstances, and for the restitution to be made, respectively.

INTEGRITES arbitration team managed to defend the Ukrainian respondent and to prove that nearly all the claims against it were groundless. The arbitral tribunal has agreed with the overwhelming majority of the arguments of the INTEGRITES lawyers and dismissed the main claims, in particular: on invalidation of additional agreements and application of restitution; on recovery of loss of profit, penalties and moral damages.

In 1998 he graduated from the Kazakh State Law University (Almaty), with a diploma in law, with distinction, afterwards he obtained his master degree in petroleum law and policy at Dundee University (1998–1999). Rashid then qualified as a solicitor of England and Wales, firstly undertaking his academic training at BPP Law School (London) and then he had two years of training at the London office of international law firm Norton Rose.

Rashid is a Vice-Chairman of the British-Kazakh Law Association (BrKLA) and member of the Management Committee of Kazakhstan Bar Association (KazBar).

On January 30-31, 2018 in London, the Conference C5’s International Disputes and Asset Recovery involving Russian and CIS Parties took place.

During the event, leading legal practitioners in the field of international court and arbitration disputes discussed the most topical for today problems and challenges that they face in their work and emphasized that a well-coordinated cooperation of lawyers from different jurisdictions is a key to achieve the required for the client result with the maximum efficiency.

During the presentation, Dmytro Marchukov shared his experience in recognition and enforcement of foreign court and arbitration awards in Ukraine, defining the most widespread reasons of their failure to be performed as well as paid a special attention to the latest amendments to the Ukrainian legislation related to this issue.

Olena Perepelynska, Partner and Head of CIS Arbitration Practice at INTEGRITES, delivered a speech at the International Scientific and Practical Conference “International Commercial Arbitration in Russia and in Worldwide: Trends of Development and Modern Practice” dedicated to the 85th anniversary of the ICAC at the CCI of the Russian Federation.

In her presentation, Olena Perepelynska commented on the enforcement of the ICAC at the CCI of Russia awards in Ukraine, which has been the jurisdiction of the most active foreign users of this arbitration institution services – for the period 2005-2016 the ICAC at the CCI of Russia had 375 cases involving Ukrainian parties. Olena also commented on the new procedure for recognition and enforcement of foreign arbitral awards in Ukraine.

The international law firm INTEGRITES acted as a Ukrainian legal advisor to Turkeximbank in a deal to finance the Ukrainian bank Credit West. Crediting was provided with the aim to finance Ukrainian imports from Turkey. The total amount of the transaction was $ 750,000.

On January 15, at Gymnasium No. 117, pupils from 9-11 grades had a meeting with well-known and successful graduates of the school. Volodymyr Pavlenko, a former student of the 117th Gymnasium, and now Partner and Head of Litigation Practice at INTEGRITES, shared his experience and knowledge with the pupils.

The meeting was held in the “question-answer” format, during which everyone was able to ask Volodymyr different questions, as well as to learn a lot about the peculiarities of his profession. For example, students were interested in the features of the lawyer’s work and asked advice for future lawyers.

Volodymyr gladly answered questions from students, and shared his unique experience, practical knowledge and advice on how to start a lawyer’s career, how to find the first job, and what kind of knowledge you need to have to become a good specialist.
