INTEGRITES White-Collar Crime Practice Team successfully defended interests of a client who was suspected by the the law enforcement bodies in receiving undue benefits. Our team represented by Volodymyr Rudnychenko, Counsel, Mykola Nychyporuk and Stanislav Borys, Associates, and Kostiantin Kornieiev, Paralegal, got the court to choose an appropriate measure of restraint.

On July 13, 2018, a client addressed to INTEGRITES to protect interests, including during court hearing on choosing the measure of restraint. Despite that, the law enforcement authorities filed a motion to the court to choose the measure of restrain in the form of detention with setting the bail in the amount of UAH 1 million, our lawyers succeeded in tailoring the materials to ground their position of defense in less than half a day and convinced the court that the prosecution’s motion was baseless. As a result of a lengthy court hearing, during which the prosecution failed to challenge the arguments of the While-Collar Crime Practice Team, the court chose house arrest as a measure of restraint.

INTEGRITES have successfully defended interests of the Ukrainian enterprise in the arbitration against Russian chemical giant with USD 30 million at stake.

 In this case, Russian company launched arbitration against Ukrainian enterprise under the Arbitration Rules of the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry. It sought to recover USD 22 million of direct damages and lost profit, USD 2,5 million penalties and moral damages, as well as requested specific performance in form of an additional delivery of goods according to the contract in amount of more than USD 5,5 million.

INTEGRITES team of lawyers acted as counsel to the Ukrainian respondent. It has succeeded to prove that almost all claims were baseless and forced the claimant to abandon some of them even during the arbitral proceedings, including the claim on additional delivery of goods. The arbitral tribunal concurred with the arguments advanced by INTEGRITES lawyers on deficiency of basis and evidence that would be necessary to recover amounts claimed. As a result, it dismissed main claims; in particular, the claim for recovery of lost profit, penalties and moral damages in full as well as the claim for recovery of the lion’s share of direct damages.

INTEGRITES is proud to announce that its team helped the Client prevail in a hard-fought litigation in front of the commercial court of appeals and, ultimately, the Supreme Court. The firm acted for Euroins Ukraine, a Ukrainian insurance company (part of a large European financial services holding), against its former minority shareholder and senior manager. The latter challenged important corporate resolutions adopted by the Client’s shareholders. In the outcome, the claims against our Client were denied in full.

The winning team included Oksana Riabinina, Associate, and Anastasiia Solenova, Paralegal, who worked under the supervision of Dmytro Marchukov, Head of Cross-Border Litigation. “We are glad to bring the result to the Client, which it aimed for and which, no doubt, it deserved. The claims, which Euroins Ukraine had to defend, were part of a broader attack against its main shareholder that was conceived as from Day 1 – if not Day 0 – after it came to Ukraine. The opposite result would have created all sorts of problems to the Client’s business further down the road. Therefore, this case was a huge responsibility for us,” – said Dmytro Marchukov.

Olena Perepelynska, Partner and Head of CIS Arbitration practice at INTEGRITES, President of the Ukrainian Arbitration Association, has been appointed by the International Chamber of Commerce’s (ICC) World Council as Ukraine’s alternate member of the ICC International Court of Arbitration. The appointment has been made on the proposal of the President of the Court and is affective as of 1 July 2018 for the following three years, until 2021. The Council appointed 176 Court members from 104 countries, with unprecedented gender equality, generation and geographical diversity.

Commenting her appointment Olena Perepelynska said that “It is my huge honor to be appointed as Ukraine’s alternate member of the ICC International Court of Arbitration and I am excited to take part in current and future initiatives of the new Court.
