The dispute resolution practice of INTEGRITES Moscow office successfully represented the client’s interests, the leading international sea towage company, against one of its key employees, captain of the ship, who filed suit to recover over 54 thousand US dollars of presumably unpaid wage indebtedness. The importance of the case for the client also was that the employee intended to change the remuneration system adopted by the company, taking advantage of the ambiguous, in his opinion, interpretation of recently adopted legal norms, thereby attempting to significantly increase the company wage fund.
As a result of a proactive legal position, the practice team, represented by the partner Andrey Ryabinin and lawyer Violetta Korolkova, secured a full claim dismissal judgment in the first instance court.
“Traditionally, labor disputes are one of the most difficult for employers, since courts in countries with strong social policies often stand up for the protection of employees. Such disputes tend to have a public resonance – satisfying claims of one employee entails a “domino effect”: after one court decision, the rest of employees pile the company with lawsuits. In addition, state authorities initiate labor law compliance audits of companies who faced labor lawsuits, which often leads to imposing administrative fines for companies and its top management”.
