INTEGRITES has advised Flooring Industries Ltd Sarl on the Ukrainian law matters in three litigations against the Ukrainian debtor before German courts. The firm assisted in the collection of evidence and further successfully represented the client in the proceedings before the Ukrainian court for recognition and enforcement of the resulting German judgment.
The recognition proceedings involved several novel issues for Ukrainian courts, such as recognition of the default judgment (which proved to be challenging due to strict requirements of the Ukrainian law regarding proper notification of the respondents) and concurrent recognition of the cost order.
“We believe this is one of the very few cases where German judgment in commercial matters was recognized in Ukraine. Apart from establishing a positive practice in Ukraine, it should also facilitate enforcement of the Ukrainian judgments in Germany based on the reciprocity principle in future”, – comments Dmytro Marchukov, Partner and project lead at INTEGRITES.
