The cross-border dispute involving German, Cyprus and Russian parties arose from the failure to perform the payment obligations exceeding USD 7 million for the delivery of hi-end technology equipment supplied to German subsidiary of Russian vendor of super-computers.
The trial involved a number of complex procedural issues, application of the Vienna Convention on Contracts for the International Sale of Goods (the CISG) in addition to Russian substantive law, as well as tactical attempt by the respondents to delay the judgment through false settlement negotiations.
In a final judgment the judge confirmed the validity of the claim, awarding the firm’s client with the full amount of claim.
