Serhiy Shershun

Serhiy Shershun, Ph.D. in Law, a Counsel of Antitrust & Competition Law practice, as well as a lead specialist in public procurement and environmental protection matters. While working as a State Commissioner for Antimonopoly Committee of Ukraine, Serhiy Shershun was responsible for ensuring compliance with competition law, primarily in the areas of telecommunications, financial services, and transport. Serhiy Shershun actively participated in a significant number of investigations related to the violations of competition legislation, in particular in cases of anticompetitive concerted actions during public procurement, committed by large public and private companies within markets of electric energy, pharmaceuticals etc. Serhiy has acquired a special on-hand experience in the field of prevention of unfair competition, especially in the form of misuse of business reputation, achievement of improper advantage in competition over other market players. Serhiy Shershun, in close cooperation with European experts, drafted key bills related to the sphere of protection of economic competition, organization, and conduct of public procurement, as well as environmental protection.

Education

Serhiy Shershun studied law at the National University of Ostroh Academy (Bachelor of Law with honor), and at the National Taras Shevchenko University of Kyiv (Master of Law with honor). In addition, Serhiy has defended a thesis at the Institute of State and Law of V. M. Koretsky National Academy of Sciences of Ukraine in the field of environmental protection. As of today, Serhiy Shershun holds a Ph.D. in Law. In addition, Serhiy successfully graduated from the School of Senior Civil Service of the National Agency of Ukraine for Civil Service, and completed the program on  legal systems in Central and Eastern Europe at the Vilnius University.

Professional experience

Serhiy Shershun worked as the main legal counsel in government authorities, advisor on legal issues in the investment and industrial group. For a long time, Serhiy Shershun served as the State Commissioner of the AMCU, as well as the head of the Board of AMCU on Public Procurement. He also represented Ukraine in the Committee on Competition of the Organization for Economic Cooperation and Development (OECD) and the International Competition Network (ICN).

The list of Serhiy’s clients includes, in particular, Turkish Airlines, PJSC “Farmak”; Watsons, CRH Ukraine Ltd., Novo Nordisk and many others.

Recent experience
  •           defending the interests of Farmak Public Joint Stock Company (PJSC Farmak), a leading pharmaceutical firm in Ukraine, in the exclusive and complex case regarding the abuse of dominant position on the national market of medical substances used for the production of completed pharmaceutical products;
  •           advising Villeroy & Boch on Ukrainian competition regulation by drafting a memorandum regarding the possibility of recommended resale prices implementation;
  •           advising Turkish Airlines during the investigation on the Ukrainian aviation market conducted by the AMCU.
