Krystyna Khripkova spoke at the International Arbitration YAR 2.0 Conference

Krystyna Khripkova, senior associate at INTEGRITES International Arbitration practice, spoke at the International Arbitration YAR 2.0 Conference in Lisbon, Portugal on 11 October 2019. The event was organized by the Young Arbitration Review, the independent online review embracing the views of arbitration practitioners from several jurisdictions and distributed worldwide.

In her presentation, Krystyna focused on the new trends in recognition and enforcement of international arbitral awards in Ukraine. In particular, she covered the recent statistics and developments which demonstrate a more pro-arbitration approach of the Ukrainian court practice. Additionally, Krystyna outlined selected case studies explaining the position of Ukrainian judges towards a ‘public policy’ ground to refuse recognition and enforcement of international arbitral awards and emergency arbitrator’s awards.

“Ukrainian court practice in arbitration-related cases is increasingly becoming more arbitration-friendly. This may be explained, to some extent, by the launch of the New Supreme Court in 2017, which started to apply concepts and best practices of the foreign courts from pro-arbitration jurisdictions. Over the past four years, less than 5% of the ICAC awards were challenged in Ukraine, while local courts set aside only one arbitral award. Ukrainian courts refused recognition and enforcement of less than 3% of the international arbitral awards in last 2,5 years”, underlined Khripkova.
