On February 2, Oleksandr Onishchenko, Partner, Head of Litigation Practice, spoke on the discussion “Strategy and tactics of the judicial process. Proofs. Counteraction to procedural sabotage “, which was held in the framework of the educational platform Legal High School.
During his speech, Oleksandr focused on more specific issues, namely, “What to do if the process is delayed by the judge: Practical advice” and spoke about how the problem of delay is solved in the legislation of other countries.
In the framework of the lecture, students learned which factors influence the processing time and analyzed how the problem of delay is solved in the legislation of other countries. Oleksandr in his report drew attention to the fact that the European Court of Human Rights specified a list of cases that need to be considered immediately, namely, labor disputes, cases involving injuries, child custody cases and others.
Oleksandr noted that there are various ways of delaying the case, including the involvement of third parties, the excessive duration of proceedings, the unreasonable appointment of expertise, and so on.
At the end, the speaker provided practical advice in order to avoid delaying of proceedings.
