Viktoriya Fomenko spoke at the business forum COMPLIANCE 2019

Viktoriya Fomenko, Partner and Head of Tax and Customs Practice INTEGRITES made a presentation on the topic “Beneficial owner: how to be“ in compliance ”with tax and currency legislation in the light of the MLI Convention and CRS”.

Viktoriya spoke about general approaches to understanding the category of “beneficial owner”, how this concept defines the Organization for Economic Cooperation and Development, including the latest updates in the UN Model Convention and the explanations of OECD with respect to the beneficial owner.

Viktoriya Fomenko also analyzed judiciary approaches of the interpretation of the beneficial owner concept on the position of the Ukrainian and international courts.

During presentation, Viktoriya spoke about the beneficial owner in the context of automatic information exchange (CRS) and currency liberalization.

In conclusion, participants learned about the novelties in the procedure of elimination of double taxation caused by ratification of MLI convention, as well as the criteria for the application of double tax treaties taking into account the current practice.
