Serhii Uvarov

Serhii focuses on the areas of commercial and investment arbitration, arbitration-related litigation and cross-border commercial litigation.

Serhii Uvarov has been involved in arbitral proceedings under LCIA, SCC, ICC, UNCITRAL, JAMS, LMAA, ICAC at CCI оf the Russian Federation and ICAC at UCCI Arbitration Rules. His experience also includes representation of the Ukrainian state authorities and state companies before foreign courts and international tribunals.

He also advised clients on transnational insolvency and receivership, fraud investigation, including anti-bribery probes, as well as recognition and enforcement of foreign judicial and arbitral awards in Ukraine.

Recent experience
  • acting for a leading Ukrainian state-owned power-generating company in the LCIA arbitration against an international trading company regarding the quality of shipped commodities (value of the dispute – over USD 4 mln);
  • acting for a leading Ukrainian aircraft repair company  with respect to an ICC arbitration seated in Geneva against foreign contractor as regards development and installation of complex military equipment (total value of the dispute – over USD 23 mln); 
  • assisting Flooring Industries Ltd. S.A.R.L. with collection of evidence for the purpose of three (3) court proceedings against the Ukrainian debtor before German courts, as well as representing the client in the litigations before the Ukrainian court to have respective German judgments recognized and enforced (total value of the dispute – approximately EUR 14 mln);
  • representing major Ukrainian manufacturer of oil-filled power transformers and shunt reactors in the arbitration proceedings before the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation. The dispute arose out of the contract for supply of materials to the client and revolved around complex and fact specific questions regarding the criteria for reducing penalty under Russian law (value of the dispute – over USD 1,1 mln);
  • representing Ukrainian agricultural company in the arbitration proceeding before the International commercial arbitration court at the Ukrainian Chamber of Commerce and Industry. The dispute arose out of the contract for design and commissioning of the biogas electricity power plant and particularly the alleged failure by the client’s contractor to ensure proper commissioning and functioning of the power plant;
  • advising Norwegian investor into one of the largest wind farms in Ukraine with respect to the dispute resolution options, as well as the procedure for enforcement of arbitral awards against the state and state companies;
  • advising one of the largest global engineering consultancy firms with respect to the limitation of liability, choice of applicable law, enforcement of dispute resolution provisions and other potentially contentious matters relevant to the client in the context of its operations in Ukraine.
